TERMS AND CONDITIONS FOR COMPETITIONS

By participating in the STREICHELT giveaway, the participant agrees to the following terms and conditions:

  1. The giveaway is organized by Arcadia Live GmbH, Porzellangasse 7A, A-1090 Vienna (hereinafter referred to as the “Organizer”). Participation is free of charge.
  2. Between 05 February 2026 and 12 February 2026, 10:00 a.m., 1x 2 tickets for the Streichelt concert on 18 February 2026 at Rhiz Vienna will be raffled via Instagram.
  3. Eligible to participate are natural persons aged 14 years and older, excluding employees of the Organizer, persons involved in the conception and implementation of the giveaway, and their family and household members.
  4. Participation in the giveaway requires tagging another Instagram account in the comment section of the post and following the Arcadia Live Instagram account (@arcadia_live).
  5. Participants agree not to share any unlawful content. The Organizer reserves the right to exclude participants who violate criminal laws, public decency, or these terms and conditions. Furthermore, the Organizer reserves the right to exclude participants from the giveaway due to false information, manipulation, or the use of unauthorized aids, and to revoke or reclaim prizes already awarded. Participation via competition clubs, competition agencies, or automated services is excluded.
  6. The winner will be selected after the end of the giveaway using a random selection system, excluding the public. The winner will be notified via private message on Instagram. There is no obligation to accept the prize. The winner must contact the Arcadia Live Instagram channel via private message within 24 hours. If this deadline expires without response, the claim to the prize lapses. In this case, the Organizer reserves the right to select a new winner using the same procedure. No correspondence will be entered into regarding the giveaway.
  7. Legal recourse is excluded. Cash payment of the prize, exchange, or transfer to third parties is not possible. The Organizer assumes no liability or warranty for the prize.
  8. The tickets can only be collected in person by the winner at the box office of the event venue (note: presentation of a valid photo ID is required).
  9. The Organizer reserves the right to amend or supplement these terms and conditions without prior notice insofar as this is in the interest of a simple and secure execution of the giveaway, in particular to prevent misuse, or is otherwise necessary. The Organizer also reserves the right to terminate the giveaway during the participation period.
  10. The Organizer is only liable for damages caused by intent or gross negligence. This limitation of liability does not apply to damages resulting from injury to life, body, or health, or to claims under the Product Liability Act. Furthermore, this limitation of liability does not apply to breaches of essential contractual obligations.
  11. In the event of legal disputes, the law of the Republic of Austria shall apply exclusively, excluding conflict-of-law rules.
  12. Giveaways organized by the Organizer are in no way connected to Instagram and are not sponsored, supported, or organized by Instagram in any way. The Organizer releases Instagram from all damages, losses, or expenses of any kind (including attorneys’ fees and reasonable costs) and indemnifies Instagram against all claims in connection with the promotion (in particular its publication and organization).
     

PRIVACY POLICY FOR COMPETITIONS

1. Who is responsible for handling your data?
1.1. ARCADIA LIVE GmbH, Porzellangasse 7a, 1090 Vienna, telephone number: +43 (0) 1 958 05 05, e-mail address: office@arcadia-live.com (‘ARCADIA’, ‘we’, ‘us’) is responsible for adequately protecting your personal data. ARCADIA therefore complies with all legal provisions on the protection, lawful handling and confidentiality of personal data, as well as on data security.
1.2. We process your personal data as required by the General Data Protection Regulation (GDPR), the Data Protection Act (DSG) and all other relevant laws.

2. What interest does ARCADIA have in your data and for what reason and for what purpose may ARCADIA process it?
2.1. For participation in the competition, we process the following data from you (depending on the specific design): Name, age, name of the social media profile, your activities on our social media profile (e.g. a like or comment), e-mail address and postal address. The processing is carried out in accordance with Art. 6 para. 1 lit b GDPR for the execution of the competition (and thus fulfilment of the contract) and for the purpose of pre-contractual measures. The storage and processing of the data is necessary in order to organise the competition and to inform you of any winnings.
2.2. If you win, your name and, if applicable, a photo of you may be published on our social media profiles and our website. The processing is carried out in accordance with Art 6 para 1 lit f GDPR on the basis of our legitimate interests in the announcement of the winner and general marketing measures.

3. How long will your data be stored?
We process your personal data from point 2 for as long as it is necessary to process the competition and delete it within seven days of the end of the competition, unless this data must be stored beyond this period as part of statutory retention obligations. We process the winner's data for six months and beyond if we publish the data on the basis of our legitimate interests described above.

4. To whom may we disclose your data? 
4.1. The data will only be passed on to other third parties if this is necessary to fulfil (pre)contractual or legal obligations or is justified to protect our legitimate interests. For example, we transfer your personal data to external third parties to the extent necessary, e.g. shipping companies, auditors, insurers or legal representatives.
4.2. Your data may be transferred to contracted service providers (e.g. IT service providers and other service providers for processing the competition) for order processing.
 

5. What rights do you have?
5.1. If you wish, we will provide you with information about all your personal data that we process at any time. In some cases, you also have the right to data portability, i.e. to receive the personal data you have provided to us in a structured, commonly used and machine-readable format. 
5.2. Under certain circumstances, you may request the restriction of processing, rectification and erasure of your personal data.
5.3. In some of the cases mentioned above, ARCADIA is authorised to process your personal data on the basis of your voluntary consent. You can revoke this consent at any time without giving reasons with effect for the future, until then we will process your data lawfully.
5.4. Would you like to make a complaint? In this case, you can contact us via the data protection officer named under point 1.3. You also have the right to lodge a complaint with the Austrian Data Protection Authority, Barichgasse 40-42, 1030 Vienna.
If we process your data in the interests of ARCADIA or a third party, you also have the right to object at any time if there are grounds relating to your particular situation.
