1. Scope and Formation of Contract
These parking and terms of use apply to the use of the visitor car park operated by Arcadia Live GmbH during exhibitions held at METAStadt Wien.
The car park is located on private property and is not a public car park.
By driving onto the car park premises and parking a vehicle, a short-term contract for paid use under these parking and terms of use is concluded between Arcadia Live GmbH (the "Operator") and the person parking the vehicle (the "User").
The terms of use are displayed at the entrance and in the car park, and are also available online.
2. Eligibility to Use the Car Park
The car park is available exclusively to visitors of exhibitions held at METAStadt Wien, for the duration of their visit.
Use of the car park without visiting an exhibition is not permitted.
Parking authorization is valid only on the respective event day and during the exhibition's opening hours on that day.
The vehicle must be removed from the car park no later than the end of opening hours.
There is no entitlement to a specific parking space. Use is possible only within the limits of available free spaces.
3. Parking Fee and Payment
The parking fee is € 5 per vehicle for the duration of the event visit (fair use).
Payment is made on entry to the car park staff and is possible by cashless means only.
After payment, the User receives a payment receipt. This receipt also serves as the parking authorization.
Immediately after parking, the receipt must be placed behind the windscreen so that it is clearly visible from outside, and must remain visible for the entire parking period.
The receipt is valid only for the respective event day and is not transferable to other event days.
4. Parking Rules
Vehicles may only be parked in the designated and marked parking spaces.
Driveways, emergency access routes, entrances and exits, and any other closed or marked areas must be kept clear at all times.
Instructions from car park and event staff must be followed.
Drive with particular caution and at walking speed in the car park. Where applicable, the provisions of the Road Traffic Act (Straßenverkehrsordnung) apply by analogy.
Parking vehicles that are not roadworthy or safe to operate, or vehicles without an official license plate, is not permitted.
5. Non-Compliant Use and Contractual Penalty
Non-compliant use exists in particular if
- no valid payment receipt is present,
- the payment receipt is not placed clearly visible from outside behind the windscreen,
- the car park is used without visiting exhibitions held at METAStadt Wien,
- a vehicle is parked outside the marked parking spaces,
- closed areas, driveways, emergency routes, or entrances and exits are blocked,
- the vehicle remains parked beyond the exhibition's opening hours, or
- instructions from car park staff are not followed.
In the event of non-compliant or otherwise unauthorized use of the car park, a
CONTRACTUAL PENALTY OF € 40
becomes due.
The obligation to pay the regular parking fee remains unaffected.
Further statutory claims of the Operator remain reserved.
6. Inspection
Compliance with these parking and terms of use may be checked by employees or agents of the Operator.
The payment receipt displayed behind the windscreen serves as proof of valid parking authorization.
If a violation is found, a payment demand may be attached to the vehicle.
7. Removal of Vehicles
Vehicles that block rescue, escape, or traffic routes, pose a hazard, or significantly impede the operation of the car park or the event may be removed at the expense of the responsible party, within the limits of statutory requirements.
This applies in particular to vehicles that are not removed despite a request to do so, or that remain on the premises without authorization outside the permitted times of use.
8. Supervision and Liability
The contract of use grants solely the temporary right to park a vehicle in an available space.
Supervision or safekeeping of the vehicle or of any items inside it is not part of the contract.
Statutory provisions apply to the Operator's liability. The Operator is not liable for damage caused exclusively by third parties, other car park users, or other circumstances for which the Operator is not responsible.
Liability for personal injury and other mandatory statutory liability provisions remain unaffected.
9. Conduct in Case of Damage
Damage to car park facilities or to other vehicles must be reported immediately to car park or event staff.
The User is liable under the statutory provisions for damage caused by them.
10. Data Protection
Where personal data is processed in connection with car park management, this is done in accordance with applicable data protection law.
